What to Do After a Bicycle Accident in Aurora

In the first minutes following a bicycle crash, adrenaline can conceal the extent of your injuries, and the urge to ride home can be strong. Resisting that impulse is one of the smartest moves you can make. Knowing what to do after a bicycle accident in Aurora protects both your health and your right to compensation, because the actions you take at the scene can decide your case.

When a car strikes a bike, there is no frame, airbag, or seatbelt to absorb the blow. Even a low-speed impact can cause broken bones, concussions, or spinal injuries that surface days later. An experienced bicycle accident lawyer at our firm can turn those facts into a strong case for the compensation you deserve.

Steps To Take at the Crash Scene

If you are able to move, your actions in the first hour can shape your entire claim. Focus on safety first, then on the facts.

These are the steps to take at the scene following an Aurora bicycle wreck:

• Call 911 and report the collision, even if the driver wants to address it privately
• Get medical attention for any injury, no matter how minor it feels
• Photograph the vehicle, your bike, the road, and your injuries
• Collect the driver’s name, license, and insurance details
• Gather contact information from any witnesses
• Avoid apologizing or admitting fault to anyone

A police report and clear photos from the scene give your case a strong foundation from the start.

What To Do in the Days That Follow

See a doctor right away, even if you feel fine, because injuries such as concussions and internal damage often take days to appear. Follow the treatment your doctor orders, and keep records of your bills, missed work, and pain.

Stay guarded once the insurance company makes contact. Adjusters may sound friendly, but their goal is to pay you as little as possible. They may use an early recorded statement against you, so turn down the request until a lawyer is guiding you. At The Wilhite Law Firm, our lawyers can take over these conversations so you can focus on healing.

Other actions to take after your Aurora crash include saving your damaged bike, helmet, and clothing, and avoiding posting about the incident online.

Does State Law Protect Injured Cyclists?

The state gives cyclists the same rights to the road as drivers, and it holds motorists to strict duties around them. Under Colorado Revised Statutes § 42-4-1003, a driver passing a cyclist must leave at least three feet of space. When a driver crowds that space on a busy road, such as Havana Street or East Colfax Avenue, and causes an accident, that violation becomes powerful evidence of fault.

Colorado is an at-fault state, so the driver who caused your injuries is responsible for your losses. After a bike collision in Aurora, you generally have three years to file a claim under C.R.S. § 13-80-101, but waiting is risky and not what you should do because evidence fades. Acting early keeps the pressure where it belongs, on the driver and their insurer.
