To have a valid compensation claim, you will need to demonstrate that the other driver’s insurance company or party was negligent in the car accident in some manner. This negligence could include distracted driving, driving aggressively, or failure to obey the rules of the road. If you can demonstrate that the accident happened, another driver’s insurance company caused the accident and directly caused your injuries, you could pursue compensation for your losses.

What to Do If You’ve Been Hurt in a Car Crash in Fort Worth?
If you are involved in a car crash, the following tips could help you protect yourself and your rights:
Call 911 (or get someone else to do it)
When law enforcement arrives on the scene, they will fill out an accident report that contains details about the wreck, including a description of the scene, a description of motor vehicle crashes, injuries, and property damage, an initial determination of fault, contact information for those involved and for bystanders who witnessed the accident, and more.
Seek Medical Care
A physician should evaluate you within 72 hours after an accident. Follow the doctor’s orders. Get any diagnostic tests you need, such as X-rays, MRIs, etc. Attend all follow-up appointments.
Save Pictures From the Scene
Photos and videos of the scene will allow you to visually document your injuries, property damage, and more. A visual record can serve as evidence of fault and be used to help reconstruct what happened.
Save Witness Contact Information
Your attorney may wish to follow up with them later to provide a statement or even testify in court as part of your case.
Document Expenses
Keep medical records of all expenses you have incurred due to the accident and your injuries.
Maintain a Journal
Keep a daily journal in which you document your recovery process and how your injuries are affecting your daily life.
Don’t Post on Social Media
Refrain from talking about the accident in any online public forums or social media platforms. The insurance company could use anything you say to reduce or deny your claim.
Consult with a Car Accident Attorney
An experienced car accident lawyer in Fort Worth will help guide you through the claims process and protect you from making mistakes that could hurt your case. An experienced attorney can also take the burden of investigating the case, gathering evidence, calculating damages, and much more off your shoulders while you focus on your recovery.

Fort Worth Car Accident FAQs
When another driver hits you, you will typically be eligible to file a claim against their insurance. But what if the driver doesn’t have coverage, or if they flee the scene before you can get their insurance information?
In most cases, your auto insurance policy should include personal injury protection (PIP) coverage that will help you pay for medical expenses and other costs related to your injuries. In addition, if you have uninsured/underinsured motorist coverage, you can file a claim through your own insurer.
A knowledgeable Fort Worth car accident lawyer can help you explore all your options.
Texas is a modified comparative negligence state, which means that motorists partly at fault for accidents could still seek compensation as long as they are less than 51 percent at fault. However, your compensation would be reduced by your percentage of fault. So if you are found to be 10 percent at fault for a crash, your compensation would be reduced by 10 percent.
If an insurance adjuster contacts you, be polite and ask them to identify themselves. Don’t disclose any information about the accident or your injuries. Provide only limited personal information. Try to keep the conversation as brief as possible. Try to take notes during the conversation if you can, and do not allow the insurance adjuster to record you without your attorney present.
Sometimes, insurance adjusters will also quickly offer you a settlement. This is often to make your claim go away. It usually will not be the full amount that you are entitled to receive. Be sure to contact a lawyer before accepting any money from the other party’s insurer. You don’t want to take a lowball settlement right away only to find out that it will not be enough to cover your expenses and other losses down the line.
It won’t cost you anything upfront to hire a Fort Worth car accident lawyer from The Wilhite Law Firm. That’s because we represent clients on a contingency fee basis. You won’t pay any costs or legal fees unless we recover compensation for you.
