First Steps After a Bicycle Crash

Following a bicycle crash in Grand Junction, your first action should be to ensure your safety. If you can safely move from the travel lane, you should do so, then call 911. A responding officer can document the location and create a report to support your injury claim.

Seek prompt medical care, even if your injuries seem minor. Adrenaline can mask symptoms, and some injuries do not surface until later. Your medical records can connect your condition to the collision.

If you can, gather the driver’s name and insurance information. Photograph the roadway, your bicycle, and any visible injuries, then note the license plate and identify any witnesses. On routes such as North Avenue, conditions can change quickly, so early documentation is invaluable.

How Does State Law Affect Bike Collision Claims?

State law gives cyclists certain protections on the road. Under Colorado Revised Statutes § 42-4-1412, a person riding a bicycle generally has the same rights and duties as other vehicle operators, subject to bicycle-specific rules.

After an accident, fault becomes a major insurance issue, and the state follows a modified comparative negligence rule. Under Colo. Rev. Stat. § 13-21-111, the court can reduce your recovery by your share of fault and bar recovery completely if you were more than 50 percent responsible for the collision.

If you are involved in a bicycle collision in Grand Junction, you should avoid admitting fault or giving a recorded statement to the insurer before you seek legal advice. Insurers can use early statements to dispute liability or minimize your claim.

Protecting Your Claim After a Bicycle Accident

After a bike collision in Grand Junction, you can take several steps to protect your claim. Evidence is important, so keep your damaged bicycle and gear, and save your medical bills and treatment records.

Under Colo. Rev. Stat. §13-80-101, you generally have three years from the date of the accident to file a claim for an injury arising from the use of a motor vehicle. Waiting too long can weaken an investigation long before that deadline arrives.

At The Wilhite Law Firm, we can handle insurer communications and gather the proof your claim needs to succeed. From the first call, we move fast to secure evidence before it disappears and push back hard if an insurer tries to shift blame or minimize your injuries.
