Rear-End Car Accidents in Greeley

A sudden impact from behind can leave you dealing with pain, a damaged vehicle, and an insurer asking questions. Rear-end car accidents in Greeley often look straightforward, but fault becomes disputed when drivers give different accounts of what happened.

A car accident attorney helps you preserve evidence and document your injuries. At The Wilhite Law Firm, we investigate the crash and handle communications with insurers. Then we build a claim aimed at recovering the compensation state law allows. Wilhite Wins means we move quickly and fight for you from the start.

Is the Driver Behind Always at Fault?

A Greeley rear-end car crash often points toward the driver behind, because the state requires motorists to leave enough space between their vehicle and the one in front of them to react safely. Under Colorado Revised Statutes § 42-4-1008, following distance must be reasonable for the circumstances, not measured by a fixed number of car lengths.

Reasonableness matters most when roads are wet or icy. Heavy traffic also demands more caution. Bad weather does not excuse a rear-end collision, because dangerous conditions are precisely why drivers should increase their following distance.

The rear driver is not automatically responsible in every case. A front driver can share fault by reversing unexpectedly or by cutting into a lane without enough space. Fault also becomes contested when a vehicle has nonworking brake lights or the front driver stops for no reasonable traffic-related purpose.

Chain-reaction collisions further complicate the matter. When three or more vehicles strike one another in sequence, each driver tends to blame the one behind, and investigators must determine the order of the impacts before assigning responsibility.

Injuries After a Rear-End Crash Can Take Time To Appear

Your rear-end collision in Greeley can cause injuries even when the vehicles do not look severely damaged. The force of the impact moves your neck and spine abruptly, and soreness may not fully develop for a day or two. Common injuries include:

• Whiplash and neck strain
• Lower back injuries
• Shoulder soft-tissue injuries
• Headaches that begin after the impact

Prompt evaluation identifies problems that need treatment, and consistent records connect your symptoms to the collision. If your treatment lapses, expect the insurer to argue that the break, and not the collision, explains your symptoms. We gather the medical documentation and other evidence showing how the crash has affected your health.

How Fault Rules Affect What You Recover

Negligence can apply to more than one driver in a rear-impact vehicle crash in Greeley. Colorado Revised Statutes § 13-21-111 applies comparative negligence, so your share of fault reduces your damages if your negligence is less than that of the driver you seek recovery from.

An even split leaves you with no recovery, so your negligence must be less than the other driver’s, rather than equal to it. If your share is lower, the court reduces the damages in proportion to your assigned percentage of negligence. In a jury trial, the statute requires a special verdict stating the damages before any reduction and the percentage of negligence assigned to each party.

Insurance companies use disputed facts to push more blame onto you. We collect the evidence that keeps your percentage where it belongs.
