Important Legal Elements in a Catastrophic Injury Case

When pursuing a catastrophic injury claim, it’s important to understand the key legal factors that can determine the outcome of your case. From proving liability and documenting your damages to meeting strict filing deadlines and navigating shared fault rules, each element plays a critical role in securing the compensation you deserve.

The sections below break down these legal essentials, so you know what to expect and how a catastrophic injury lawyer in Fort Worth can guide you through the process.

Elements of Liability

The elements of liability include showing the court that the other person or business owed you a duty of care, such as driving safely and following traffic laws, and failed to do so, causing a breach. It must also demonstrate that their negligence directly caused avoidable accidents and your injuries. Finally, you must show proof that you suffered damages as a result, such as bodily harm, hospital costs and other medical bills, and pain and suffering.

Statute of Limitations

There is also a strict deadline for filing your claim. Pursuant to the guidelines of Texas Civil Practice and Remedies Code § 16.003, you must prepare and file the claim within two years from the date of the cause of action.

Limited exceptions may apply in some circumstances, such as when a person does not know they suffered harm immediately. The time starts on the day you reasonably discover the damage. They also place the time on hold for minors, and it starts running on their 18th birthday.

Modified Comparative Fault

The statute follows a modified comparative fault system for shared liability. If the court finds that you share under 50 percent of the fault, you can obtain compensation for the other party’s portion of liability. However, they bar recovery of damages if they determine your share is higher.

Building strong cases to show the entire extent of the negligent party’s fault is crucial in cases with severe injuries, leading to permanent disabilities, to ensure you receive a just settlement. Our seasoned serious injury lawyers in Fort Worth will advocate on your behalf, handle the legal work, and fight for the best possible outcome.
